De komende dagen en weken zal het vooral over één vrouw gaan: Sonia Sotomayor, die door president Obama is voorgedragen als rechter voor het hooggerechtshof. En het zal vooral over een zin gaan die Sotomayor zeven jaar geleden uitsprak. Ondanks al haar ervaring en wat ze heeft bereikt, zal het voor de Senaat vooral over die ene zin gaan. De zin sprak Sotomayor uit tijdens een toespraak aan de Berkeley universiteit in Californië in 2001. “I would hope that a wise Latina woman, with the richness of her experiences, would more often than not reach a better conclusion than a white male who hasn’t lived that life”, aldus Sotomayor.

Sotomayor, afgestudeerd aan de universiteiten Princeton en Yale, heeft meer dan 16 jaar professionele ervaring op juridisch federaal gebied. Ze was zes jaar een district rechter en 10 jaar van het 2nd U.S. Circuit Court of Appeals. Rush Limbaugh noemde haar een “reverse racist” en Newt Gingrich zei op Twitter: “White man racist nominee would be forced to withdraw. Latina woman racist should also withdraw” (zie bericht: Gingrich: Trek nominatie Sotomayor in). Het Witte Huis zegt dat de zin totaal uit zijn context is gehaald. “Look at the totality of it. I have confidence that people will come to a reasonable conclusion”, aldus Witte Huis perswoordvoerder Robert Gibbs. “When Obama cited the qualities he was seeking in a nominee, a diverse background was atop the list”, aldus Gibbs. “When I talk about the richness of experience, I include a life and an upbringing that are different than some people have had.” Tijdens een toespraak in 2007 op de Planned Parenthood conventie noemde Obama de criteria waar hij rechters op zou selecteren. “We need somebody who’s got the heart — the empathy — to recognize what it’s like to be a young teenage mom, the empathy to understand what it’s like to be poor or African-American or gay or disabled or old”, aldus Obama.

Sotomayor zei in haar speech in 2001 dat witte rechters historische beslissingen hebben gemaakt op het gebied van ras en geslacht, maar benadrukte dat advocaten die de beslissingen verdedigen in de rechtbank over het algemeen African-Americans en vrouwen waren. Aan het begin van haar toespraak waarschuwde ze Latino’s: “Latinas are making a lot of progress in the old-boy network.” Ze refereerde aan “two excellent studies on how women on the courts of appeal and state supreme courts have tended to vote more often than their male counterpart to uphold women’s claims in sex discrimination cases and criminal defendants’ claims in search and seizure cases”, aldus de rechter. “Personal experiences affect the facts that judges choose to see”, aldus Sotomayor. “My hope is that I will take the good from my experiences and extrapolate them further into areas with which I am unfamiliar. I simply do not know exactly what that difference will be in my judging. But I accept there will be some based on my gender and my Latina heritage.”
