President Obama heeft veel problemen waar hij mee moet omgaan, maar hij hoeft zich niet meer druk te maken of hij wel legaal president is van de Verenigde Staten. Een federale rechter verwierp afgelopen week een eventuele rechtszaak dat Barack Obama ten onrechte president is, omdat hij niet in de VS geboren is. De rechtszaak die door de zogenoemde “birthers” was aangespannen werd niet ontvankelijk verklaard De “birthers” beweren dat Obama niet geboren is op Hawaï, terwijl zijn geboorteakte het tegendeel bewijst of dat zijn burgerschap was niet geldig was toen hij als kind in Indonesië woonde. De district rechter David O. Carter van Californië zei dat de rechtbank geen jurisdictie heeft om een uitspraak te doen om een president uit zijn ambt te zetten. De rechter wilde zijn handen niet aan deze zaak branden, want dit zou kunnen leiden tot een constitutionele crisis. In het besluit van Carter staat dat de aanklagers hem probeerde te beïnvloeden “to disregard the constitutional procedures in place for the removal of a sitting president. The process for removal of a sitting president – removal for any reason – is within the province of Congress, not the courts”, zo staat in het besluit.

Carter zei ook dat de aanklagers “have attacked the judiciary, including every prior court that has dismissed their claim, as unpatriotic and even treasonous for refusing to grant their requests and for adhering to the terms of the Constitution. Respecting the constitutional role and jurisdiction of this court is not unpatriotic”, aldus de beslissing. “Quite the contrary, this court considers commitment to that constitutional role to be the ultimate reflection of patriotism.”

Of de “birthers” het er nu bij laten zitten is de vraag. Het Congres zal waarschijnlijk geen procedure starten om te onderzoeken of Obama legaal president is (zie ook bericht: Amerikaans staatsburger in het archief van augustus).
